Luna Rossa protesta il Direttore di Regata / Luna Rossa protests the Race Director

San Francisco, 2 luglio 2013 – Oggi il team Luna Rossa Challenge 2013 presenterà una protesta alla Giuria Internazionale della 34^ America’s Cup chiedendo l’annullamento delle regole introdotte dal Direttore di Regata venerdì 29 Giugno (Regatta Notice 185 e 189). Luna Rossa considera che, pubblicando questi documenti, il Direttore di Regata abbia sfacciatamente violato i regolamenti che reggono la 34^ America’s Cup, eccedendo la sua giurisdizione e la sua autorità. Come è universalmente noto, uno dei pilastri fondamentali di qualunque America’s Cup è il Regolamento di Classe, regolamento che viene proposto dal Defender ed è accettato dai challenger al momento in cui lanciano la sfida.

 

Queste regole possono essere cambiate unicamente con il consenso unanime dei team concorrenti (Art. 4 del Regolamento di Classe degli AC72), come è successo per oltre una dozzina di emendamenti introdotti durante questa Coppa.

Questa è una garanzia fondamentale a tutela dei diritti dei challengers. Lo scopo di questa norma è di impedire al Defender – o a qualunque terzo – di cambiare le regole del gioco improvvisamente e/o unilateralmente, come il Direttore di Regata sta tentando di fare in questo caso: il suo è un chiaro tentativo di mettere fuori stazza la nostra barca, a soli pochi giorni dall’inizio delle regate, con la scusa della sicurezza.

Luna Rossa è assolutamente favorevole all’introduzione di nuove e più severe norme di sicurezza (ha votato in favore di 35 delle 37 Raccomandazioni del Direttore di Regata), ma le regole relative ai timoni, agli elevatori dei timoni nonché al maggior dislocamento non hanno nulla a che vedere con la sicurezza; il loro unico effetto e la loro sola ragione di essere è quello di aumentare la velocità e le performance della barca.

Luna Rossa ha anche chiesto alla Giuria di programmare l’udienza a una data precedente alla prima regata dei Round Robin (Luna Rossa contro Emirates Team New Zealand), in calendario il 7 Luglio.

Come è stato sottolineato durante la conferenza stampa di Alameda il 17 Maggio, Luna Rossa è desiderosa di regatare nella 34^ America’s Cup, nel rispetto dei regolamenti che la governano, ma non accetterà nessuna imposizione contraria alle regole vigenti nel momento in cui ha lanciato la sfida.

San Francisco, 2^nd  of July 2013 – Today the team Luna Rossa Challenge 2013 will file a protest before the International Jury of the 34^th America’s Cup against the measures introduced by the Regatta Director on Friday 29^th of June (Regatta Notices 185 and 189).

Luna Rossa considers that, by issuing these documents, the Regatta Director has blatantly breached the rules governing the 34^th America’s Cup and has exceeded his jurisdiction and authority.

As everybody knows, one of the fundamental pillars of any America’s Cup is the Class Rule, which was proposed by the Defender and accepted by the Challengers at the moment in which they challenge.

It can only be changed with the unanimous consent of the competitors (AC72 Class Rule – Art. 4), as it has been the case more than a dozen times in this Cup.

This is the fundamental guarantee that preserves the rights of the challengers and prevents the Defender -or any other third party – to change the rules of the game abruptly and/or unilaterally, as the Regatta Director is trying to do in this case: a clear attempt to make illegal our boat just days before the start of the event, with the excuse of safety.

Luna Rossa is indeed in favour of the introduction of new and more stringent safety regulations (it has approved 35 out of the 37 Recommendations of the Regatta Director), but the measures regarding rudders, rudder elevators as well as the increased displacement have nothing to do with safety, since their only reason and effect to increase the speed and performance of the boat.

Luna Rossa has also asked that the protest is heard before the first race of the Round Robins, scheduled the 7^th of July (Luna Rossa vs. Emirates Team New Zealand).

As it was clearly stated at the press briefing in Alameda the 17^th of May, Luna Rossa is eager to race in the 34^th America’s Cup and be respectful of the rules governing it, but it will not accept any imposition contrary to the rules under which it has challenged.
